You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to misuse the Services, interfere with their operation or security, attempt to gain unauthorized access to any systems or accounts, or use the Services in violation of applicable laws or regulations.

Certain features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

02SimpliScada Services

SimpliScada provides cloud-based SCADA software and related products and services designed to help customers monitor, analyze, manage, and control connected systems and assets.

Features and functionality may vary depending on the customer’s service plan, configuration, equipment, integrations, and other requirements.

We may modify, improve, update, or discontinue features of the Services from time to time.

03Communications

By providing your contact information to SimpliScada, you agree that we may contact you regarding your inquiries, account, requested services, customer support, appointments, transactions, or other communications you have requested or consented to receive.

Communications may be sent by email, telephone, or text message where permitted by law and based on the communication preferences and consent you have provided.

04SMS/Text Messaging Terms

If you provide your mobile phone number and opt in to receive text messages from SimpliScada, you consent to receive SMS or MMS messages related to your inquiry, account, requested services, appointments, support requests, or other communications you have specifically agreed to receive.

• Message frequency may vary.
• Message and data rates may apply depending on your wireless carrier and service plan.
• You may opt out of text messages at any time by replying STOP to a message. After opting out, you may receive a confirmation message and will no longer receive SMS messages from that messaging program unless you opt in again.
• For assistance, reply HELP or contact SimpliScada at support@simpliscada.com.
• Consent to receive text messages is not a condition of purchasing any goods or services.
• Wireless carriers are not liable for delayed or undelivered messages.
• Your use of SimpliScada’s messaging services is also subject to our Privacy Policy.

05Free Trials and Demonstrations

SimpliScada may offer free trials, demonstrations, evaluations, or other promotional access to the Services. Trial features, duration, limitations, and eligibility may vary.

SimpliScada may modify or discontinue a trial or promotional offering at any time, subject to any separate written agreement between SimpliScada and the customer.

06Fees and Payment

Certain Services require payment. Pricing, payment schedules, subscription terms, setup costs, and other fees may be provided in a separate order form, proposal, agreement, or other purchasing document.

You agree to pay all applicable fees associated with the Services you purchase in accordance with the applicable agreement.

07Customer Responsibilities

Customers are responsible for ensuring that their use of SimpliScada and any connected equipment, controllers, networks, systems, or infrastructure complies with applicable laws, regulations, safety requirements, and organizational policies.

Customers are also responsible for determining whether actions performed through the Services are appropriate for their specific equipment, facilities, and operating environment.

08Availability and Third-Party Services

We work to maintain reliable access to the Services, but we do not guarantee that the Services will always be uninterrupted or error-free.

Certain functionality may depend on internet connectivity, telecommunications providers, wireless carriers, third-party software, hardware, APIs, or other services outside SimpliScada’s control.

SimpliScada is not responsible for interruptions or failures caused by third-party systems or services outside our reasonable control.

09Intellectual Property

The Services, including software, designs, graphics, interfaces, trademarks, logos, documentation, and other content provided by SimpliScada, are owned by or licensed to SimpliScada and are protected by applicable intellectual property laws.

Except as expressly authorized, you may not copy, reproduce, distribute, modify, reverse engineer, sell, license, or otherwise exploit SimpliScada’s intellectual property.

10Privacy

Your use of the Services is subject to our Privacy Policy, which explains how SimpliScada collects, uses, stores, and protects personal information.

11Suspension or Termination

We may suspend or terminate access to the Services if we reasonably believe that a user has violated these Terms, applicable law, security requirements, or another agreement governing their use of SimpliScada.

Customers may terminate paid Services according to the terms of their applicable subscription, order form, or service agreement.

12Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.

SimpliScada does not guarantee that the Services will be uninterrupted, error-free, or suitable for every particular application or operating environment.

Nothing in these Terms replaces any warranties or service commitments expressly provided in a separate written agreement between SimpliScada and a customer.

13Limitation of Liability

To the fullest extent permitted by applicable law, SimpliScada will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services.

Any additional limitations of liability contained in a separate written agreement between SimpliScada and a customer will also apply.

14Changes to These Terms

We may update these Terms periodically to reflect changes to our Services, business practices, or legal requirements.

When changes are made, we will update the “Last Updated” date at the top of this page. Your continued use of the Services following an update constitutes acceptance of the revised Terms to the extent permitted by law.
